Saudi Kafala Transfer Eligibility 2026: Check If You Qualify in 5 Minutes
You do not need a 40-page legal memo to know whether you can move jobs. You need four facts: your job category, how long you have been with this employer, whether wages and permits are clean, and whether the next company can legally receive you.

What “Kafala transfer” actually means now
People still say “Kafala transfer” or “Iqama transfer.” In Saudi systems the formal action is transfer of an expatriate worker’s services — نقل خدمات العامل الوافد — filed on Qiwa by the Ministry of Human Resources and Social Development (MHRSD).
Saudi Arabia did not delete sponsorship overnight. What changed under the Labour Reform Initiative is mobility for most private-sector workers covered by the Labour Law. After defined conditions, you can move to a new employer without waiting for the current sponsor to “release” you by hand. Contracts must sit on Qiwa. Exit and re-entry flows run through Qiwa and Absher.
That is the useful 2026 picture. It is also incomplete if you are a domestic worker, a private driver, a guard, a shepherd, or a gardener attached to a household. Those roles were carved out of the original LRI mobility package and still follow a different track, often through Musaned rather than the standard Qiwa job-offer flow.
The 5-minute eligibility check
Work through these questions in order. Stop when you hit a hard no — or a clear yes.
If answers 1–4 are clean, you are in the normal transfer lane. If answer 3 is no, jump to the exception list. If answer 4 is no, the problem is not your eligibility — it is the receiving employer’s compliance file.
Two legal paths, not one slogan
Search results often shout “transfer without kafeel permission.” The accurate split is narrower.
| Path | When it applies | What you still owe |
|---|---|---|
| With current employer consent | Any time during a valid contract, including the first year | Notice in the contract; final settlement; new Qiwa offer |
| Without consent — contract end | Fixed-term contract expired or lawfully ended | New offer on Qiwa; no “release letter” ritual |
| Without consent — one year + notice | Private-sector worker, 12 months served, LRI conditions met | Electronic notice; serve the notice period unless waived |
| Without consent — employer breach | Unpaid wages, expired permit, no Qiwa contract, and similar listed failures | Proof (WPS, Iqama dates, Qiwa status); sometimes a labour complaint |
World Bank and MHRSD-aligned summaries of LRI mobility list the same core tests: you must be an expatriate under the Saudi labour system, complete one calendar year from entry, hold a documented Qiwa contract, receive a new job offer on Qiwa, and notify the current employer while respecting notice.
When you do not wait 12 months
These are the situations most workers mean when they ask “can I leave a bad sponsor now?” Official and widely cited implementing summaries include:
- Wages unpaid for three consecutive months — Wage Protection Program records are the cleanest proof.
- Employer did not issue a work permit within 90 days of arrival.
- Work permit or Iqama expired and was not renewed.
- Labour contract was never registered on Qiwa.
- Employer is absent through travel, imprisonment, death, or similar inability to manage the relationship.
- Proven commercial concealment (تستر) where the worker is not a party to the offence.
- Current employer approves the transfer anyway — consent still works on day one.
Some 2025–2026 practice notes also flag Saudization / Nitaqat non-compliance that forces cancellation of a worker’s permit, and labour-case no-shows. Treat those as fact-specific. File through official channels rather than assuming an automatic button will appear on Qiwa.
The receiving company has six gates
Workers obsess over their own year-count. HR teams lose transfers because the new establishment cannot receive anyone. MHRSD’s transfer-request service is commonly summarised as requiring all of the following together:
- Valid commercial registration
- Active establishment status
- Valid work permits at the unified-entity level
- Wage Protection Program compliance
- Nitaqat classification of Green or above for most entities
- Sufficient balance / quota in the establishment account
Green Nitaqat alone is not enough. A red-band firm generally cannot pull expat services in, issue or renew work permits, or request new visas. If a recruiter promises you a transfer into a company that cannot open Qiwa for inbound workers, the offer is not an offer yet.
How the Qiwa transfer actually runs
Keep screenshots of the Qiwa offer, acceptance, WPS salary history, and Iqama dates. If the current employer later claims you “abandoned work,” those records are the file.
Notice, end-of-service, and money you should count first
Eligibility to transfer is not the same as walking out tomorrow with no financial consequence. Unless a listed breach lets you leave under the Labour Law’s just-cause provisions, expect:
- Contractual notice, or pay in lieu if both sides agree in writing
- End-of-service award calculated on the ending contract
- Possible deductions if you skip notice without a legal basis
- No lawful demand that you pay the new employer’s transfer fees — that cost sits with the receiving establishment in normal commercial hiring
If the next role is in another Gulf state rather than another Saudi company, you are not doing a Kafala transfer. You are exiting and applying again. Compare that path with Visaora’s UAE job-loss grace period guide and the Oman GCC resident visa checker before you burn a Saudi status for a maybe.
What still goes wrong in 2026
Reforms increased legal mobility. They did not erase leverage. Workers and monitors still report employers who:
- Delay or contest the Qiwa notification instead of processing a clean file
- Push a final-exit or “discontinued from work” action as pressure
- Hold passports or personal documents they should not hold
- Promise a transfer into a company that fails Nitaqat or WPS gates
The US State Department’s 2025 Trafficking in Persons narrative on Saudi Arabia notes both the LRI mobility design — change of employer after contract end or one year without permission, via Qiwa — and the practical gap when employers retaliate. Use official portals, not middlemen who ask you to pay for a “release.”
If the fight is about unpaid wages or a frozen Iqama, document first, then complain through MHRSD channels. A transfer request filed with no evidence of the exception you claim will stall.
Who should not use this checklist
Skip the standard five-minute flow if you are:
- A domestic worker or household employee on Musaned
- Undocumented, overstaying, or already marked absconding
- On a visit visa hoping to “convert” inside the Kingdom
- Trying to move into a red-band or inactive establishment
Those cases need status repair or a different visa class, not a blog-shaped Qiwa click-path. For broader application-risk thinking — finances, ties, and document gaps — see how to check visa approval chances in 2026.

Frequently asked questions
Can I transfer without my employer’s consent in 2026?
Yes in defined cases: one year of service under LRI rules, an expired or ended contract, or a listed employer failure such as three months of unpaid wages or an unrenewed permit. Household roles are not on the same track.
Does “Kafala abolished” mean I can change jobs any day?
No. Sponsorship mechanics still sit under residency and work-permit rules. What changed is contractual mobility for covered private-sector workers, not a free daily hop between companies.
Is the one-year clock from contract date or entry date?
LRI summaries used by international institutions count one calendar year of service from the date of entry to the Kingdom with that employer. Use Qiwa and border/Iqama dates, not memory.
Can a red Nitaqat company take me?
Generally no. Inbound transfer of expat services is tied to the receiving firm’s band and other compliance gates. Ask the new HR team to confirm they can open the Qiwa transfer service before you resign.
Do I still serve notice if I qualify without consent?
Usually yes, unless a legal breach pathway lets you leave immediately. Qualifying to transfer and skipping notice are different questions. Read the authenticated Qiwa contract.
Where do I verify the live rule, not a blog?
Qiwa for the filing service, MHRSD for labour rules, Absher or Muqeem for residency completion. This page is planning guidance. Confirm the button you see in your own account before you act.
Next step if the file is messy
If wages, Iqama dates, or the new employer’s Nitaqat status are unclear, map the gaps before you accept an offer. Visaora’s Intelligence Suite is optional paid analysis for risk, documents, and timing — it does not replace MHRSD or a licensed lawyer.
